Introducing
TERMS OF SERVICE
Hello and welcome! We are glad that you are taking the time to read these terms of service (the “Terms”).
These Terms are important as they, together with your booking confirmation email (the “Booking Confirmation”), set out the legal terms on which Travel Services are made available to you through our Service.
They also cover any interactions or communications you have with us through our Service.Your use of our Service is conditioned upon your acceptance of these Terms.
BEFORE
Inspect your vehicle for any existing damages and verify if they are listed on your rental agreement. If not, alert a VIU Rental employee to record them BEFORE leaving the branch.
DURING
Refill your tank before returning if you did not purchase our prepaid fuel option; otherwise, you will be charged a per-gallon rate as stated in your contract. Keep a copy of your receipt as you may be asked to present it upon returning the vehicle.
AFTER
Check the trunk, glove box, center console, and under the seats for personal belongings before returning your vehicle. A Customer Service Associate will log the fuel, miles, and any damages.
Rental Agreement Terms and Conditions
Definitions
“Agreement” means the Terms and Conditions in these Terms and Conditions and the provisions found on the Face Page provided to you on the day of your rental (the “Face Page”). “You” or “your” means the person identified as the renter in this Agreement, any person signing this Agreement, any Authorized Driver, or any person or organization to whom charges are billed by us at its or the renter’s direction. All persons referred to as “you” or “your” are jointly and severally bound by this Agreement. “We”, “our”, “VIU Rental” or “us” means VIU Rental LLC.
“Additional Driver” means a person we list on the Face Page of this Agreement. “Authorized Driver” means the renter, any Additional Driver, or any other individual but only where required by applicable state law. An “Unauthorized Driver” means anyone who is not the renter, any Additional Driver, nor any other individual as required by applicable state law.
For rentals with pick-up locations in California, Illinois, Missouri, Nevada, Oregon, Texas, New York, Utah, and Wisconsin, “Authorized Driver” includes your spouse. For rentals with pick-up locations in California, Illinois, Missouri, Nevada, Oregon, Texas, Utah, and Wisconsin, “Authorized Driver” includes your employer and co-workers (who are not your employees, except for Wisconsin) who are engaged in business activity with you.
For rentals with pick-up locations in Illinois, Missouri, and Texas, “Authorized Driver” also includes employees who are engaged in business activity with you. For renters with pick-up locations in Illinois, Missouri, New York, Oregon, Texas, Utah, and Wisconsin, “Authorized Driver” also includes any person who drives the Vehicle to a medical or police facility under circumstances reasonably believed to constitute an emergency. For renters with pick-up locations in Utah and Wisconsin, “Authorized Driver” also includes any person who operates the Vehicle while parking it at a commercial establishment.
Each Authorized Driver must have a valid driver’s license for the duration of the rental period or their reservation period, whichever period is longer, and, at most locations, be at least age 21. For renters with pick-up locations in New York, the renter and renter’s spouse must be at least 18 years old. Authorized Drivers are the only persons permitted to drive the Vehicle. To the extent permitted by law, we may charge an additional fee for each Authorized Driver (other than the renter).
“Vehicle” means the motor vehicle identified in this Agreement and any vehicle we substitute for it, and all its tires, tools, accessories, equipment, keys, and Vehicle documents, but “Vehicle” does not include portable navigation devices or other optional equipment (“Optional Equipment”) that you rent from us.
“LDW” means Loss Damage Waiver. “PDW” means Partial Loss Damage Waiver, and is not offered in the states of California, Colorado, Nevada, North Carolina, Oregon, and Virginia.
“Loss of Use” means the loss of our ability to use the Vehicle for any purpose (including, but not limited to, non-rental uses such as general display of the Vehicle, display of the Vehicle for sale, non-revenue transportation by employees) due to damage to or loss of the Vehicle during your rental.
“Diminished Value” means the difference between the value of the Vehicle immediately prior to damage or loss, and the value of the Vehicle after repair or replacement.
“Vehicle License Fee” means our estimate of the average per day per vehicle portion of charges imposed by governmental authorities on us, including our total annual vehicle licensing, titling, plating, inspection, and registration costs, or to recover other similar charges as permitted by applicable law. We do not charge Vehicle License Fees in New Jersey or New York. For Virginia, the “Vehicle License Fee” means our estimated average per day per vehicle portion of our total annual vehicle licensing, titling, and registration costs.
Rental, Indemnity, and No Warranties.
This is a contract for rental of the Vehicle. The price provided on your Face Page applies only to the specific rental period stated on the Face Page. If you return your Vehicle early or late, your price is subject to change.
To the extent permitted by law, VIU Rental may terminate this Agreement and repossess the Vehicle at your expense without prior notice if you breach this Agreement, if the Vehicle is abandoned, or if it is used in violation of law or this Agreement.
To the fullest extent permitted by law, you agree to indemnify, defend, and hold VIU Rental harmless from all claims, liability, costs, and attorney fees arising from or resulting from this rental and your use of the Vehicle.
VIU Rental makes no warranties, express, implied, or apparent, regarding the Vehicle, including but not limited to any warranty of merchantability or any warranty that the Vehicle is fit for a particular purpose.
You agree not to alter the Vehicle or any Optional Equipment. If you or any Authorized Driver determine that the Vehicle or any Optional Equipment is unsafe, you or the Authorized Driver must stop operating the Vehicle or Optional Equipment immediately and notify us.
This paragraph applies to the fullest extent permitted by New Jersey law and does not relieve VIU Rental of any responsibility or liability imposed by New Jersey law, including the New Jersey Consumer Fraud Act or any implied warranty of fitness under New Jersey law.
Telematics Notice and Release.
You acknowledge that the Vehicle may be equipped with a telematics device, global positioning satellite (“GPS”) technology, an electronic locator device, and/or an event data recorder. VIU Rental may locate, monitor, or disable the Vehicle through such systems if deemed necessary, without warning or notice, to the extent permitted by applicable law. Remote monitoring may include the collection of Vehicle data, such as location, odometer readings, oil life, fuel level, tire pressure, battery charge, diagnostic trouble codes, and other elements that VIU Rental may deem necessary.
VIU Rental is not responsible for the operability of any telematics, navigational, or other systems included with the Vehicle. You acknowledge that these systems may use cellular telephone, wireless technology, Bluetooth technology, or radio signals to transmit data, and therefore your privacy cannot be guaranteed.
You authorize any person’s use, disclosure, or access to location information, automatic crash notifications, and operational Vehicle reporting conditions, as permitted by law. You shall inform any and all drivers and passengers of the Vehicle of the terms of this section and that you have authorized the release of information as provided herein.
To the fullest extent permitted by law, you agree to release, indemnify, defend, and hold VIU Rental harmless for any damage to persons or property caused by the failure of the telematics device to operate properly, or otherwise arising from the use of the telematics device.
Third-party telematics service providers are not agents, employees, or contractors of VIU Rental. Your use of a telematics system during the rental is subject to the terms of service and privacy policy of the third-party telematics system provider.
The Vehicle may collect and store personal information if you choose to connect your smartphone or other device to the Vehicle’s Infotainment System. VIU Rental does not access, collect, or use any information that may be stored by the Infotainment System. If you choose to connect your device to the Infotainment System, you acknowledge and agree that information from your device may be stored by the Vehicle’s Infotainment System.
This paragraph applies to the fullest extent permitted by New Jersey law and does not relieve VIU Rental of any responsibility or liability imposed by New Jersey law, including the New Jersey Consumer Fraud Act.
Condition and Return of Vehicle
You must return the Vehicle to our rental office or any other location identified by VIU Rental on the date and time specified in this Agreement and in the same condition that you received it, except for ordinary wear.
If the Vehicle is returned to a different office or location, or left at an unauthorized location, you remain responsible for the safety, damage to, or loss of the Vehicle until it is inspected by VIU Rental. In such cases, you authorize us to charge your credit or debit card a one-way fee or service charge, plus any additional costs incurred to retrieve and return the Vehicle.
If the Vehicle is returned after business hours, you remain responsible for the safety, damage to, or loss of the Vehicle until we inspect it during the next business opening.
Any servicing of the Vehicle, or replacement of parts or accessories during the rental period, requires our prior written approval.
You are responsible for checking and maintaining all fluid levels, ensuring the Vehicle remains in a roadworthy condition, and locking the Vehicle at all times when not in use. You must return the Vehicle with at least the same amount of fuel as it had at the time of rental unless you have purchased a pre-paid fuel service from VIU Rental.
No refund or credit will be issued if you return the Vehicle with more fuel than it had when rented.
Responsibility for Damage or Loss. Reporting to Police; Responsibility for Fees; Responsibility for Optional Equipment.
Responsibility for Damage or Loss
You are responsible for all damage to, and for loss or theft of, the Vehicle, including damage caused by collision, weather, road conditions, and acts of nature, even if you are not at fault. This includes damage caused by the optional use or misuse of autonomous features on the Vehicle. You agree to follow all manufacturer instructions when using autonomous features and acknowledge that you use them at your own risk. It is your responsibility to inspect the Vehicle for damage before leaving our facility.
You are responsible for the cost of repair, or the actual cash retail value of the Vehicle as of the date of loss if the Vehicle is not repairable or if VIU Rental elects not to repair it. You are also responsible for Loss of Use (without regard to fleet utilization), Diminished Value, and any administrative expenses incurred in processing a claim.
You must report all accidents, theft, and vandalism to VIU Rental and the police as soon as you discover them.
You are responsible for paying directly all parking citations, toll fees (subject to Section 5a below), fines for toll evasion, and other fees, fines, court costs (including on appeal), and penalties assessed against you, us, or the Vehicle during this rental. If you fail to pay these charges and VIU Rental pays them on your behalf, you agree to reimburse us for all such amounts. Additionally, you will pay an administrative fee of up to $40 per charge.
You agree that VIU Rental may provide any information requested by law enforcement authorities as part of any investigation of an alleged infraction. If any tickets, citations, fines, penalties, or administrative fees are assessed against VIU Rental due to the operation or use of the Vehicle during your rental period, you agree to indemnify us for all resulting damages, losses, costs, and expenses.
VIU Rental has no obligation to contest or defend you against any alleged infraction. However, we may, at our sole discretion, decide to pay any of the fines or fees discussed in this section on your behalf without your prior approval and seek reimbursement from you under the terms of this section. You authorize us to charge your credit or debit card for these amounts.
For rentals with pick-up locations in the state of California, VIU Rental will be responsible for any fines assessed against you, us, or the Vehicle that are based solely on the Vehicle’s lack of a toll transponder.
VIU Rental may use a third party as its agent to process and bill tickets, citations, fines, and penalties. You authorize us to release rental and payment card information to our agent for the purpose of processing and billing you for any tickets, citations, fines, and penalties incurred by you or assessed against us or the Vehicle during your rental, plus an administrative fee not to exceed $40 per violation.
You further authorize our agent to contact you directly regarding any ticket, citation, fine, or penalty assessed in connection with your use of the Vehicle during the rental period.
Tolls
You agree that if you do not purchase one of the toll products offered by VIU Rental, you will use “Cash” lanes only on toll roads during your rental. Failure to pay the toll at a Cash lane or driving the Vehicle through an automated express/toll lane will result in additional fees.
If you use an automated express/toll lane without using your own transponder or purchasing one of our toll products, you agree to pay VIU Rental an administrative fee of $14.99 per usage day, up to a maximum of $90 per rental agreement, plus the applicable toll fee for each time you use an automated express/toll lane during your rental.
These fees will be charged to your credit or debit card after the close of your rental transaction.
Optional Equipment
Upon request and subject to availability, VIU Rental offers certain Optional Equipment, including but not limited to, Child Seats and Global Positioning Devices (GPS), for your use during the rental at an additional charge. All Optional Equipment is rented AS IS and must be returned to us at the end of the rental period in the same condition as when rented. Optional Equipment is not part of the Vehicle.
You are responsible for any loss or damage to any Optional Equipment, regardless of the cause, even if you have accepted LDW or PDW. You must review the operational instructions for all Optional Equipment before leaving the rental location.
If you rent a Child Seat from us, you assume sole responsibility for inspecting and properly installing the seat yourself. VIU Rental makes no warranties, express, implied, or apparent, regarding the Child Seat or any other Optional Equipment, including but not limited to any warranty of merchantability or warranty of fitness for a particular purpose. You are responsible for all injury or damage arising out of or related to your use of the Child Seat or any other Optional Equipment.
If you choose to rent a Global Positioning Device (GPS) from us, you are responsible for returning it in the same condition as when rented, along with all included accessories such as the carrying case, car charger, windshield mount, and, where provided, the console beanbag mount (GPS Accessories).
If the GPS unit or any GPS Accessories are lost or damaged, and in VIU Rental's sole opinion require repair or replacement, you agree to pay us the fair market value for its repair or replacement.
Loss Damage Waiver; Prohibited Use of the Vehicle; Roadside Assistance
Loss Damage Waiver
LDW (Loss Damage Waiver) and PDW (Partial Damage Waiver) are not insurance, are optional, and may duplicate other coverage you already have. If you purchase LDW or PDW, VIU Rental waives your responsibility for the portion of damage to or loss of the Vehicle as stated on the Face Page.
However, damage to or loss of EV charging kits, vehicle jacks, tire repair kits, or similar accessories not considered part of the Vehicle itself is not covered under LDW or PDW. Your responsibility for damage to these items will not be waived.
PDW is not available if you pick up your rental in the states of California, Colorado, Nevada, North Carolina, Oregon, or Virginia.
VIU Rental will not waive your responsibility, even if you purchased LDW or PDW, under the following circumstances:
1- If you provide false, fraudulent, or misleading information prior to or during the rental, and we would not have rented the Vehicle or extended the rental period had the true information been known.
If you fail to notify VIU Rental and the police of an accident, theft, or vandalism involving the Vehicle.
If the damage or loss results from a prohibited use, including but not limited to:
a. (a) Use by anyone who is not an Authorized Driver.
b. (b) Operation by anyone under the influence of drugs or alcohol.
c. (c) Use of the Vehicle during the commission of a felony or other crime, other than a minor traffic violation.
d. (d) Use while carrying passengers or property for hire, pushing or towing anything, participating in races, speed tests, or contests, or teaching someone to drive.
e. (e) Transporting dangerous, hazardous, or illegal materials.
f. (f) Use outside the geographic area specified on the Face Page or in Mexico.
g. (g) Driving on unpaved roads.
h. (h) Transporting more persons than there are seat belts, carrying passengers outside the passenger compartment, or transporting children without legally required child safety seats.
i. (i) Tampering with or disconnecting the odometer.
j. (j) Operating the Vehicle when fluid levels are low, or when continued use would cause damage that a reasonable person should recognize.
k. (k) Damage caused by carrying items on the roof, trunk, or hood, inadequately securing cargo inside the Vehicle, or transporting animals in the Vehicle.
l. (l) Leaving the Vehicle unlocked, or losing, stealing, or leaving the keys or key fob in the Vehicle when not in operation.
m. (m) Misuse of the Vehicle’s manual transmission due to lack of experience (if applicable).
n. (n) Failure to allow sufficient 2o. (o) Damage caused by willful, wanton, or reckless acts or misconduct.
p. (p) Fueling the Vehicle with the wrong type of fuel.
q. (q) Driving or operating the Vehicle while using a hand-held wireless communication device (e.g., phone, text messaging device) without using hands-free mode.
In the event of a loss due to theft of the Vehicle, VIU Rental will not waive your responsibility unless you return all Vehicle keys or ignition devices provided to you at the time of rental.
Lost or Damaged Keys or Key Fobs
Even if you purchase LDW or PDW and do not violate the terms detailed in Paragraph 6 above, you will remain responsible for the following:
1. A service fee for replacing lost or damaged keys or key fobs and for delivering replacement keys or key fobs, or for towing the Vehicle to the nearest VIU Rental location if you lose the keys or key fob to the Vehicle.
2. A service fee for delivering replacement keys or key fobs, or for towing the Vehicle to the nearest VIU Rental location, if you lock the keys or key fob inside the Vehicle and request assistance from VIU Rental.
3. Additional service fees for flat tire assistance or jump-start services requested during the rental period.
Roadside Assistance Protection.
Roadside assistance is available to all renters. In some cases, VIU Rental may offer additional Roadside Assistance Protection.
If you purchase the optional Roadside Assistance Protection, we will provide you with 24/7 breakdown assistance (where available) at no additional charge. Roadside Assistance Protection includes:
• Replacement of lost keys or key fobs,
• Flat tire service (cost of a replacement tire is not covered),
• Jump-start services, and
• Key lockout services.
If you do not purchase Roadside Assistance Protection, you may incur additional costs if we provide any of the services listed above.
When deciding whether to purchase Roadside Assistance Protection, you may wish to check whether you already have other coverage for these services.
Roadside Assistance Protection is not insurance and is optional. It will be void if you are in breach of this Agreement, including any of the prohibited uses listed in Paragraph 6.
Prohibited Uses, Electric Vehicles.
Prohibited Uses
Where permitted by law, the following, in addition to the prohibitions listed above in the Loss Damage Waiver section, shall be considered Prohibited Uses of the Vehicle, unless explicitly granted written permission by VIU Rental:
- Use by anyone without first obtaining VIU Rental’s written consent.
- Use by anyone who is not a qualified and licensed driver.
- To carry persons or property for hire, livery, On-Demand service, or as part of a Transportation Network Company (e.g., Uber, Lyft).
- To propel or tow any vehicle, trailer, or other object.
- Use in any race, test, or contest.
- For any illegal purpose or in the commission of a crime.
- To instruct an unlicensed person in the operation of the Vehicle.
- If the Vehicle is obtained from VIU Rental by fraud or misrepresentation.
- To carry persons outside the passenger compartment of the Vehicle.
- Loading the Vehicle beyond its rated capacity.
- Operation while under the influence of alcohol or other intoxicants, such as drugs or narcotics, or under any other physical or mental impairment that adversely affects the driver’s ability to operate the Vehicle.
- Intentionally causing damage to or loss of the Vehicle.
- Driving on any surface other than a paved road or graded private road or driveway.
- Use of the Vehicle in an unsafe, reckless, grossly negligent, or wanton manner. Violating a traffic law or receiving a ticket in an accident does not automatically constitute a violation of this provision but may be an indication that a violation has occurred.
- Operation by a driver younger than the minimum age set forth in this Agreement.
- Driving the Vehicle outside of the geographic area provided in the Rental Information on viurental.com and on your Face Page.
Prohibited use of the Vehicle constitutes a violation of this Agreement, voids all liability and other insurance coverage (where permitted by law), makes the Vehicle subject to immediate recovery by VIU Rental, and makes you responsible for all loss of or damage to the Vehicle, regardless of the cause. This includes, but is not limited to, VIU Rental’s expenses, such as loss of use.
Electric Vehicles
If your Vehicle is an electric vehicle (EV), the following terms shall apply in addition to the rest of the terms in these Terms and Conditions:
Charging:
a. You are responsible for ensuring that the Vehicle is adequately charged during the rental period.
b. You must use designated electric vehicle charging stations or compatible charging equipment to recharge the Vehicle.
Return Condition:
a. The Vehicle must be returned with at least the minimum charge level specified on your Face Page or communicated at the time of rental.
b. If the Vehicle is returned with less than the minimum charge level, you may be charged a recharging fee as stated in your rental agreement.
Charging Equipment:
a. If the Vehicle includes a charging kit, cables, or other charging accessories, you are responsible for returning all such equipment in the same condition as received.
b. You are liable for any loss, damage, or failure to return charging equipment, and VIU Rental may charge you the fair market value for repair or replacement.
Improper Use:
a. You must not use incompatible chargers or attempt to modify the charging equipment.
b. Damage caused by improper charging, tampering with the charging system, or misuse of EV-specific features will be considered a violation of this Agreement, and you will be responsible for all associated costs.
Range Responsibility:
a. You are responsible for monitoring the Vehicle’s remaining range and ensuring you have sufficient charge to reach your destination or a charging station. VIU Rental is not responsible for delays, inconvenience, or costs associated with running out of charge.
Towing and Recovery:
a. If the Vehicle becomes inoperable due to insufficient charge, you will be responsible for any towing and recovery costs.
Charge Level at Return
You agree to return your electric Vehicle (EV) with a battery charge of at least 80% or to the charge level at which the Vehicle was provided to you at the start of the rental.
- If the Vehicle is returned with a charge below 80%, or below the charge level at which it was provided, you agree to pay a $35 charging fee.
- If the Vehicle is returned with a charge below 20%, you agree to pay an additional $20 fee (in addition to the $35 charging fee).
These fees will be charged to your credit or debit card after the rental is closed.
Tesla Terms
Charging.
1. If your electric Vehicle is a Tesla, the following additional terms apply:
- If your rental is through a VIU+ subscription service, the terms in this Section 8c do not apply, and the terms outlined in the VIU+ Terms and Conditions shall govern.
- Your Tesla Vehicle is permitted to access Tesla Superchargers for charging (subject to Tesla’s Terms and Conditions).
- If you use a Tesla Supercharger during your rental, VIU Rental will be directly billed for the charging costs. These charges will then be invoiced to you after your rental is completed.
- This charge may not appear on your final rental invoice but may be billed separately at a later date.
- You are not obligated to use Tesla Superchargers.
2. Tesla Key Card/Fob and J1772 Adapter.
- If the Tesla Key Card or Key Fob provided to you is lost or damaged, you agree to pay the replacement cost, including all related service costs.
- The Key Card/Fob must only be used to operate and charge your rented Vehicle.
- Sharing the Key Card/Fob, using unauthorized key cards or fobs, or charging any other vehicles with the provided key is strictly prohibited.
- You are responsible for returning the J1772 adapter provided with the Vehicle. If the adapter is not returned, you agree to pay the replacement fee.
Charging Generally.
You agree that you are responsible for all fees associated with the use of any public or private charging stations during your rental period. This includes, but is not limited to:
- Charging fees,
- Idle fees, and
- Any other related costs.
You further agree that you are fully responsible for, and will indemnify VIU Rental for, any damage caused to charging station equipment or locations during your rental period, including all related repair and service costs.
In addition to Section 3 above, you acknowledge that your electric Vehicle may be equipped with a dash cam that may record incidents during your rental period. Such recordings may be reviewed and used by VIU Rental after the completion of your rental.
You further acknowledge that it is your responsibility to delete any personal data collected or stored by the electric Vehicle during your rental period. This may include, but is not limited to, GPS history, Bluetooth connections, and other user-generated settings.
If the Vehicle prompts you to perform a software update, you agree to ignore the request unless specifically instructed by VIU Rental to proceed with the update. You acknowledge that failing to comply with this instruction is done at your own risk, and VIU Rental accepts no responsibility or liability arising from such actions
Towing.
If your electric Vehicle requires towing for any reason, you agree that you must contact VIU Rental immediately, and the tow must be arranged through VIU Rental.
Unauthorized towing is strictly prohibited, and you will be responsible for all costs and damages resulting from any towing not coordinated by VIU Rental.
Insurance
Insurance
When Supplemental Liability Insurance (SLI) or Business Travel Protection is purchased or included as specified on the Face Page, liability coverage from VIU Rental shall be primary up to the minimum financial responsibility (FR) limits required by the laws of the state where the loss occurs.
If additional liability coverage is declined on the Face Page, the following applies:
VIU Rental, as the insured, complies with applicable motor vehicle FR laws. Unless required by law, VIU Rental does not extend any of its liability coverage to any Authorized Drivers, passengers, or third parties under this Agreement.
You are responsible for all damage or loss you cause to others. You agree to maintain liability insurance during the rental term, which provides the following primary coverage to the owner, to us, and to you:
- (a) Bodily Injury (BI) and Property Damage (PD) liability coverage;
- (b) Personal Injury Protection (PIP), no-fault, or similar coverage where required;
- (c) Uninsured/Underinsured Motorist (UM/UIM) coverage where required; and
- (d) Comprehensive and Collision Damage coverage extending to the Vehicle.
If liability insurance or self-insurance is available on any basis to the Renter, Additional Authorized Drivers (AAD), or any other driver and satisfies the applicable state FR limits, then VIU Rental extends none of its liability coverage.
However, if the Authorized Driver complies with the Terms and Conditions of this Agreement and VIU Rental is obligated by law to extend its liability coverage to the Authorized Driver or third parties, then VIU Rental's obligation is limited to the applicable state FR limits where the loss occurs.
Unless required by law, VIU Rental does not extend liability coverage to:
• Any claims made by passengers while riding in, getting in, or getting out of the Vehicle.
• Liability imposed or assumed under any worker’s compensation act, plan, or contract.
Where permitted by law, by signing this Agreement, VIU Rental and you reject UM, UIM, and supplemental no-fault or PIP coverages. Where such coverage is required by law, both parties select the minimum limits required.
Our insurance policy contains exclusions, conditions, and limitations applicable to anyone claiming coverage. You agree to:
- Cooperate with our insurer if any claim is made, and
- Provide immediate notice to VIU Rental of any damage, claim, or lawsuit against you.
Our insurance applies only in the United States and Canada.
Charges and Costs
You will pay VIU Rental at or before the conclusion of this rental, or on demand, all charges owed under this Agreement, including those shown on the Face Page and:
1. Mileage Tampering:
a. A mileage charge based on our experience if the odometer is tampered with.
2. Taxes and Fees:
a. Applicable taxes, surcharges, or other government-imposed fees.
3. Recovery Costs:
a. All expenses incurred in locating and recovering the Vehicle if you:
i. Fail to return the Vehicle,
ii. Return it to a location other than specified, or
iii. If VIU Rental repossesses the Vehicle under this Agreement.
4. Legal and Collection Fees:
a. Costs including pre- and post-judgment attorney fees incurred while collecting payments or enforcing rights under this Agreement.
5. Cleaning Fee:
a. A reasonable fee not exceeding $400 if:
i. The Vehicle is returned substantially less clean than rented, or
ii. There is evidence of smoking or vaping.
6. Towing and Other Costs:
a. Charges for towing, impound, storage, forfeitures, court costs, and penalties resulting from your use of the Vehicle.
7. Airport and Concession Fees:
a. Where permitted, charges such as:
i. Airport facility fees and/or concession recovery fees,
ii. Vehicle license recovery fees, and other fees or surcharges.
8. Late Returns and Extensions:
a. Special rates, vehicle upgrades, or free services apply only to the initial rental period.
b. If the Vehicle is returned after the Due-In Date, you may be charged:
i. The standard rates for each additional day (or partial day), which may be substantially higher.
ii. Standard fees for previously free equipment or services.
c. No Refunds: Prepaid amounts will not be refunded if the Vehicle is returned early.
9. Final Audit:
a. All charges are subject to a final audit. If errors are found, you authorize VIU Rental to correct the charges with your payment card issuer.
10. Card Authorization:
a. You authorize VIU Rental to charge the credit/debit cards provided for:
i. Advance deposits, incremental authorizations, and amounts owed.
ii. Payments refused by a third-party billed.
b. You also authorize re-initiation of charges that are dishonored for any reason.
Long-Term Reservations (28+ Days):
Reservations for more than 28 consecutive days will be governed as follows:
1. Rental Periods:
a. The reservation consists of separate Rental Periods of up to 28 days each.
b. Each Rental Period is distinct but contributes to the overall reservation period (LT Reservation Period).
2. Rental Agreements:
a. For each new Rental Period:
i. A new rental agreement will be sent to you via email.
ii. You must review, sign electronically, and provide the Vehicle’s current mileage.
b. If no response occurs within 3 consecutive days:
i. The agreement will be deemed accepted.
3. Payment Timing:
a. On the first day of each Rental Period, you will be charged the gross total for that agreement.
b. If payment fails:
i. You must provide an alternative payment method.
ii. VIU Rental will attempt to contact you via email for 3 days:
1. Days 1–2: Informing you of failed authorization.
2. Day 3: Notify you to return the Vehicle within 24 hours.
iii. If unreturned and unpaid, the Vehicle will be deemed overdue and subject to recovery.
4. Charges During LT Reservation Period:
a. Rates for time and mileage will remain the same as the initial Rental Period.
b. Applicable fees and taxes are subject to change.
5. Returning the Vehicle Early:
a. If the Vehicle is returned before the end of a Rental Period:
i. Your daily rate will be recalculated based on the actual length of the rental.
ii. You may incur a higher daily rate.
iii. Refunds, if applicable, will be issued within 3–15 business days.
6. Extensions and Overdue Vehicles:
a. If you need to extend your rental, you must contact VIU Rental.
b. Failure to contact VIU Rental by the Due-In Date will result in the Vehicle being treated as overdue, and standard overdue procedures will apply.
Deposit
At the start of the rental, you authorize VIU Rental to place a hold on your credit or debit card for an amount up to three times the estimated total rental charges, but not less than $200 or the amount specified on the Face Page. For vehicles in the executive or luxury categories, you authorize VIU Rental to reserve up to $5,000 on your credit card. This deposit may be applied toward any amounts you owe under this Agreement. The deposit amount does not limit your total financial responsibility under this Agreement. Any unused portion of the deposit will be released upon completion of the rental. The timing of the release depends on your debit or credit card issuer's policies, and funds may not be immediately available.
Text Messages, Phone Calls, and Emails.
By signing the Face Page, you expressly consent to VIU Rental, or its agents, contacting you at the phone number(s) and email address(es) you provided in connection with your rental. This contact may include informational, transactional, or promotional content, such as customer surveys, notices, confirmations, reservations, receipts, invoices, billing details, collection communications, advertisements, events, promotions, and other information related to goods, services, rental programs, or products offered by VIU Rental, including fuel and toll options available for your rental.
You confirm that you are the subscriber or regular user of the phone number(s) and/or email address(es) provided and are authorized to receive messages from VIU Rental at this contact information.
You further authorize VIU Rental, or its agents, to send or deliver messages, including telephonic sales calls, using live agents, prerecorded or artificial voices, virtual assistants, voicemail transmissions, ringless voicemail, emails, or automated systems such as autodialed calls, texts, or emails using an automatic telephone dialing system. Such messages may be delivered at any time, including outside the hours of 8 a.m. to 8 p.m. in your time zone.
Your consent to receive these messages is not required, either directly or indirectly, as a condition to purchasing goods or services from VIU Rental or to executing your rental agreement.
Your Property.
Your Property
You release VIU Rental, its agents, and employees from all claims for loss of or damage to your personal property, including digital data or information from any mobile device linked to any telematics device or system in the Vehicle. This release applies to any personal property belonging to you or any other person that we received, handled, stored, or that was left in or on the Vehicle, any service vehicle, or in our offices, regardless of whether the loss or damage was caused by our negligence or otherwise.
The Vehicle may be equipped with an infotainment system that allows you to pair your personal mobile devices. If paired, the system may download your personal contacts, communications, location data, or other digital information. If you choose to pair your device during the rental, you are responsible for unpairing it and wiping all personal information from the Vehicle’s system before returning it.
Breach of Agreement.
The actions listed in Paragraphs 6 and 7 constitute prohibited uses of the Vehicle and will result in a breach of this Agreement. You will also be in breach of this Agreement if you permit any individual other than the Renter or an Authorized Driver to operate the Vehicle. If an Unauthorized Driver causes damage to the Vehicle or injury to others, you will be held fully responsible for all resulting damages, costs, and liabilities.
By signing this Agreement, you waive all recourse against VIU Rental for any criminal reports, investigations, or prosecutions initiated by law enforcement as a result of your breach of this Agreement.
Modifications
No term of this Agreement may be waived or modified except through a written document signed by an expressly authorized representative of VIU Rental. Rental counter representatives of VIU Rental are not authorized to waive, alter, or amend any term of this Agreement.
If you wish to extend the rental period, you must return the Vehicle to our rental office for inspection and obtain a written amendment from us before the Due-In Date.
This Agreement constitutes the entire agreement between you and VIU Rental, superseding all prior discussions, representations, or agreements related to this rental, which are hereby considered void.
Severability
If any provision of this Agreement is found to be unlawful, contrary to public policy, void, or unenforceable, all remaining provisions will remain in full force and effect. This provision does not apply in New Jersey. In the event that New Jersey law is applicable to this Agreement, the Agreement will be interpreted and enforced in accordance with the laws of New Jersey.
Waiver
Waiver
A waiver by us of any breach of this Agreement does not waive any subsequent breach or the performance of your obligations under this Agreement. Our acceptance of payment from you, or our failure, refusal, or neglect to exercise any of our rights under this Agreement, does not constitute a waiver of any other provision of this Agreement. To the extent permitted by law, you release us from any liability for consequential, special, or punitive damages in connection with this rental or the reservation of a Vehicle.
The limitation on recovery of consequential, special, or punitive damages does not apply to claims in New Jersey based on personal injuries resulting from the negligent, reckless, or intentional acts of VIU Rental, does not release us from any implied warranty of fitness applicable under New Jersey law, and does not apply to violations of the New Jersey Consumer Fraud Act.
Arbitration Agreement and Class Action Waiver.
You and VIU Rental each waive your right to a jury trial or to participate in a class action under the following terms. You and VIU Rental agree to arbitrate any and all claims, controversies, or disputes of any kind ("claims") against each other, including but not limited to claims arising out of or relating to this Agreement, our products and services, charges, advertisements, or rental vehicles, including claims based on contract, tort (including intentional torts), fraud, agency, negligence, statutory or regulatory provisions, or any other source of law. The arbitrator, and not any federal, state, or local court or agency, shall have the authority to resolve any and all disputes related to the interpretation, applicability, enforceability, or formation of this Agreement, including but not limited to any claim that all or part of this Agreement is void or voidable.
You and VIU Rental agree that no claims will be asserted in a representative capacity on a class-wide or collective basis, and no arbitration forum will have jurisdiction to decide any claims on a class-wide or collective basis. No rules for class-wide or collective arbitration will apply.
The parties agree that either party may bring an individual action in a small claims court with valid jurisdiction, provided that the action is not part of a class action, private attorney general action, or other representative or collective action. The parties also agree that claims involving a third-party insurance company separately providing coverage to you, personal injury claims, or claims related to the application of your financial responsibility concerning the use or operation of the Vehicle may be brought in a court with valid jurisdiction.

Payment
Price
The price of the Travel Service(s) will be as displayed on our Service, except in cases of obvious error.
Prices for Travel Services are dynamic and can change at any time. Price changes will not affect bookings already accepted, except in cases of obvious error. We display many Travel Services, and we try hard to ensure that the displayed price is accurate. We reserve the right to correct any pricing errors on our Service.
If there is an obvious error and you have made a booking, we will offer you the opportunity to keep your booking by paying the correct price or we will cancel your booking without penalty. We have no obligation to make available Travel Services to you at an incorrect (lower) price even after you have been sent a Booking Confirmation, if the error should reasonably have been apparent to you.
Taxes
The prices displayed through our Service may include taxes or tax recovery charges. Such taxes or tax recovery charges may include amounts associated with value-added tax, goods and services tax, sales tax, occupancy tax and other taxes of a similar nature.
Taxes or tax recovery charges are generally calculated or estimated on the prices displayed through our Service before any discounts (including those funded by us), coupons and loyalty rewards that may be applicable to your booking, unless those discounts, coupons and loyalty rewards are considered as a reduction in price for the purposes of calculating or estimating taxes in the relevant jurisdiction for the booking.
You acknowledge that except as provided below with respect to tax obligations on the amounts received from you, including facilitation fees and service fees where applicable in accordance with Section 6A(Stays) below, our Group of Companies does not collect taxes for remittance to applicable taxing authorities. The tax recovery charges on Pay Now bookings are a recovery of the estimated taxes that our Group of Companies pay to the Travel Provider for taxes due on the services provided by the Travel Provider (such as for the rental rate for the room). The Travel Providers are responsible for remitting applicable taxes to the applicable taxing jurisdictions. Taxability and the appropriate tax rate vary greatly by jurisdiction. The actual amounts paid by our Group of Companies to the Travel Providers may vary from the tax recovery charge amounts, depending upon the rates, taxability, etc. in effect at the time of the actual use of the services provided by the Travel Provider.
Sales, use and/or local hotel occupancy taxes are imposed on the amounts that our Group of Companies charge for services they provide (service fee and/or facilitation fee) in certain jurisdictions. The actual amount imposed on services provided by our Group of Companies may vary depending on the rates in effect at the time the services are provided by the Travel Provider. In certain jurisdictions, our Group of Companies are responsible for collecting and remitting sales, use and/or local hotel occupancy taxes for the entire price, including the amounts we charge for our services as well as the Travel Services provided by the Travel Provider.
In certain jurisdictions, you may be responsible for paying local taxes imposed by local tax authorities (such as city taxes or tourist taxes, etc.). Our Group of Companies or the Travel Provider may charge you such local taxes. Our Group of Companies will notify you of any local taxes that will be payable by you before you complete your booking, where such taxes have been notified to our Group of Companies by the Travel Provider.
The amount of local taxes can change between the booking date and stay date. If taxes have changed by your stay date, you may be liable to pay taxes at the higher rate.
Payment processing
For certain Travel Services, such as a Package (as defined in Section 6G(Packages), payment may be charged by more than one party (as will be shown on your payment method statement), however the total amount charged will not exceed the total price of all the Travel Services.
When payment is taken at the time of your booking and paid for in the local currency of our Service (as relevant), the company taking that payment (via third-party payment processors) and charging your payment method will be the company set out next to the relevant location of our Service in the table below.
